1. Introduction

Koekkoek Int. Horsetransport B.V. ("Koekkoek", "we", "us", or "our") is committed to protecting the privacy and personal data of our clients, business partners, and platform users. This policy applies to all services provided by Koekkoek Int. Horsetransport B.V., including but not limited to: horse transport logistics, stable management, passport processing, order management, and all associated digital tools accessible through the Koekkoek platform.

By using our services or accessing the platform, you acknowledge that you have read and understood this Privacy Policy.

Koekkoek Int. Horsetransport B.V. determines the purposes and means of processing your personal data (Data Controller). altacode.eu provides and maintains the technical platform used to deliver our services (Data Processor), and processes data strictly on behalf of and under the instructions of Koekkoek Int. Horsetransport B.V., in accordance with a data processing agreement compliant with Article 28 of the GDPR.

3. Categories of Personal Data We Collect

3.1 Identity & Contact Information

When you do business with Koekkoek, we collect information necessary to identify you and communicate with you:

  • Full name, including any business or trading names
  • Company or organization name and registration details
  • Phone number(s), including mobile and landline
  • Email address(es)
  • Business address(es), including pickup and delivery locations used in transport orders
  • Country of residence or business registration

3.2 Equine Data

As a specialist horse transport company, we process detailed information about the horses entrusted to our care. This data may be associated with you as the owner, agent, or authorized representative:

  • Horse name, date of birth, gender, color, and breed
  • Universal Equine Life Number (UELN)
  • Microchip identification number
  • Passport scans and digitized passport data
  • Health documentation, vaccination records, and veterinary certificates
  • TRACES (Trade Control and Expert System) certificates and transport authorization documents
  • Studbook registration information
  • Stable check-in and check-out records, including transit and hotel stays

3.3 Financial & Transactional Data

  • Transport order details, pricing, and cost information
  • Invoice numbers and payment status
  • Payment method preferences (wire transfer, cash)
  • Billing addresses and VAT numbers where applicable

3.4 Platform & Technical Data

When you use the Koekkoek platform, we automatically collect certain technical information necessary for operation and security:

  • Account credentials (passwords are cryptographically hashed and never stored in plain text)
  • Session identifiers and authentication tokens
  • IP address at the time of access
  • Browser type and version, operating system, and device type
  • Timestamps of login, logout, and platform interactions
  • Access logs recording which platform features were used and when

3.5 AI-Processed Data

Our platform utilizes WAI (Wail AI), a proprietary AI system, to assist with data entry, document processing, and operational efficiency. In the course of this processing, the following data may be collected:

  • Transport order data submitted for AI-assisted parsing and data entry
  • Document scans submitted for automated text extraction and processing
  • Correction and feedback data generated when staff review and adjust AI outputs
  • Anonymized usage patterns used to improve AI accuracy over time

4. Legal Basis for Processing

We process your personal data based on one or more of the following legal grounds, as defined under Articles 6 and 9 of the GDPR:

4.1 Performance of a Contract (Article 6(1)(b))

We process your data where it is necessary for the performance of a contract to which you are a party, or to take steps at your request prior to entering into a contract. This includes processing data to manage transport orders, arrange pickups and deliveries, issue invoices, and deliver the services you have requested.

4.2 Legal Obligation (Article 6(1)(c))

We are required by law to process certain data, including:

  • EU Council Regulation (EC) No 1/2005 on the protection of animals during transport — requires detailed transport documentation
  • TRACES system compliance — mandatory for intra-EU animal movements
  • Dutch fiscal retention laws — require financial records to be retained for 7 years
  • Veterinary and customs authority requirements for cross-border horse transport
  • Government inspection obligations — we must be able to produce records of animals that have passed through our facilities

4.3 Legitimate Interest (Article 6(1)(f))

We process certain data based on our legitimate interests, provided those interests are not overridden by your rights and freedoms. Our legitimate interests include:

  • Maintaining the security and integrity of the platform
  • Preventing fraud, unauthorized access, and security incidents
  • Improving service quality and operational efficiency through AI-assisted processing
  • Internal business analytics and reporting

4.4 Consent (Article 6(1)(a))

Where required, we will obtain your explicit consent before processing your data. This applies to optional processing activities such as marketing communications. You may withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

5. How We Use Your Data

Your personal data is used for the following specific purposes:

  • Creating, managing, and fulfilling horse transport orders
  • Coordinating pickup, transit, and delivery logistics across multiple countries
  • Generating and maintaining TRACES certificates and compliance documentation
  • Managing stable check-in and check-out for horses in transit or hotel stays
  • Processing passport scans and extracting identification data through WAI
  • AI-assisted data entry to reduce manual errors and improve processing speed
  • Generating invoices, tracking payments, and managing financial records
  • Assigning drivers, trucks, trailers, and routes for transport operations
  • Communicating with you regarding your orders, schedules, and service updates
  • Maintaining audit trails for regulatory compliance and government inspections
  • Platform access control, session management, and account security
  • Responding to your inquiries, support requests, and data rights requests

6. Data Recipients & Sharing

We share your personal data only where necessary and only with the following categories of recipients:

6.1 Government & Regulatory Authorities

We are legally required to share certain data with veterinary services, customs authorities, and regulatory bodies in the countries through which horses are transported. This includes TRACES documentation, health certificates, and transport records. This sharing is mandatory and cannot be opted out of.

6.2 Transport Partners

Drivers, receiving stables, and operational partners receive only the data necessary for order fulfillment, such as pickup/delivery addresses, horse identification details, contact information, and scheduling data.

6.3 Platform Provider

altacode.eu (Wail Ettouil), as the technical provider and data processor, has access to platform data as necessary to operate, maintain, and secure the platform. Additionally, non-sensitive operational logs (containing no personal client data, horse owner details, or financial information) may be transferred to altacode.eu for security assessment and platform protection.

We never sell, rent, or trade your personal data to third parties. Your data is only shared where legally required or strictly necessary for the delivery of services you have requested from Koekkoek Int. Horsetransport B.V..

7. Data Storage & Infrastructure

All personal data processed through the Koekkoek platform is hosted on servers located in Germany, within the European Union. AI processing through WAI is performed via infrastructure located in the Netherlands and Germany.

We have implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including but not limited to encryption in transit, access controls, regular security assessments, and data backup procedures.

7.1 International Transfers

Your personal data is not transferred outside the European Economic Area (EEA) except as follows:

  • altacode.eu: Non-sensitive operational and security logs (containing no personal client data, horse owner information, or financial data) may be transferred to altacode.eu infrastructure for security assessment and platform protection purposes

Where any transfer outside the EEA is necessary, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs) approved by the European Commission, or an adequacy decision under Article 45 of the GDPR.

8. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law. The following retention periods apply:

  • Client and order data: retained for the duration of the business relationship plus 7 years following its conclusion, in compliance with Dutch fiscal retention requirements (Algemene wet inzake rijksbelastingen, Article 52)
  • Horse health and transport records: retained as required by EU Regulation (EC) No 1/2005 and relevant national implementing legislation for animal transport documentation
  • Financial records and invoices: retained for 7 years from the end of the fiscal year in which the transaction occurred, as required by Dutch tax law
  • Session and authentication data: automatically expires and is deleted after 24 hours (standard sessions) or 30 days (persistent sessions)
  • AI training and improvement data: retained in anonymized form; personally identifiable information is removed within 12 months of collection
  • Access and security logs: retained for up to 12 months for security monitoring, then automatically purged

Upon expiry of the applicable retention period, your data is securely deleted or irreversibly anonymized. Where multiple retention periods apply to the same data, the longest applicable period governs.

9. Cookies & Tracking Technologies

The Koekkoek platform uses only strictly necessary cookies that are essential for the platform to function. We do not use:

  • Third-party tracking or analytics cookies
  • Advertising or retargeting cookies
  • Social media tracking pixels
  • Cross-site tracking technologies of any kind

The cookies we use are limited to:

  • Session authentication cookies: securely store your login session to keep you authenticated as you navigate the platform
  • Security cookies: protect against cross-site request forgery (CSRF) and other common web security threats

Because these cookies are strictly necessary for the operation of the platform and do not track you for marketing or analytical purposes, they are exempt from cookie consent requirements under the ePrivacy Directive (2002/58/EC) as amended.

10. Automated Decision-Making & Profiling

The Koekkoek platform uses WAI (Wail AI) to assist with data entry, document processing, and operational efficiency. WAI is designed as an assistive tool: it generates suggestions and pre-fills data fields, but all outputs are reviewed, verified, and confirmed by authorized staff before any action is taken.

We do not make any decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you, as prohibited by Article 22 of the GDPR.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. Where changes are material, we will notify you through the platform or by other appropriate means before the changes take effect.

We encourage you to review this page periodically. The "Last updated" date at the top of this page indicates when the policy was last revised. Continued use of the platform after changes have been published constitutes acceptance of the revised Privacy Policy.

1. Introduction & Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the Koekkoek platform and all services provided through it. By accessing or using the platform, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Koekkoek Int. Horsetransport B.V. ("Koekkoek", "we", "us", or "our"). The platform technology is provided by altacode.eu (Wail Ettouil).

2. Definitions

  • "Platform" — the Koekkoek web application and all associated interfaces, including but not limited to the administration panel, client portal, guest check-in system, driver interface, executive dashboard, and all related mobile and desktop-accessible features
  • "Service" — the horse transport logistics management services delivered through the Platform, including order management, route planning, stable management, document processing, and regulatory compliance tools
  • "User" — any individual or entity that accesses or interacts with the Platform, regardless of role, including staff members, clients, drivers, and guest users
  • "Client" — a customer of Koekkoek Int. Horsetransport B.V. who uses the Platform in connection with horse transport services
  • "Staff" — employees, contractors, and authorized personnel of Koekkoek Int. Horsetransport B.V. who operate the Platform
  • "WAI" — Wail AI, the proprietary artificial intelligence system integrated into the Platform for data processing and operational assistance
  • "Content" — all data, text, images, documents, and other materials uploaded to, generated by, or displayed on the Platform

3. Service Description

The Platform provides comprehensive digital tools for managing international horse transport logistics. These tools include, but are not limited to:

  • Transport order creation, management, and tracking
  • Route planning and journey management
  • Stable and barn management for transit and hotel stays
  • Horse passport scanning and identification data extraction
  • TRACES certificate management and regulatory compliance
  • Invoice generation and financial record management
  • AI-assisted data entry and document processing
  • Morocco export documentation and manifest generation
  • Driver assignment and fleet management
  • Client communication and access management

The Platform is developed, maintained, and technically operated by altacode.eu (Wail Ettouil) under license to Koekkoek Int. Horsetransport B.V..

4. Accounts, Access & Authentication

4.1 Account Types

The Platform supports multiple access levels, each governed by specific authorization requirements:

  • Staff accounts are created and managed by authorized administrators. Staff access is role-based, with permissions ranging from basic staff to engineer-level access
  • Client access is granted through secure, unique access codes issued by Koekkoek staff. Client access is scoped to the issuing company's data only
  • Driver access is granted to authorized transport drivers for operational purposes
  • Guest access is provided for stable check-in operations

4.2 User Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials, access codes, and session tokens
  • You must not share your credentials with unauthorized individuals
  • You must immediately notify Koekkoek if you suspect unauthorized use of your account
  • You are responsible for all activities that occur under your account

4.3 Session Management

For security purposes, concurrent sessions may be restricted. Logging in on a new device may automatically terminate your existing sessions. We reserve the right to terminate any session at any time for security reasons without prior notice.

5. Permitted Use & Restrictions

The Platform and all its features are provided exclusively for legitimate business conducted with or on behalf of Koekkoek Int. Horsetransport B.V.. You may only use the Platform for purposes directly related to Koekkoek's services.

Restricted Use Notice Use of any Platform feature — including but not limited to passport scanning, WAI processing, document generation, data tools, and export functions — for any purpose outside of authorized Koekkoek Int. Horsetransport B.V. business is strictly prohibited and constitutes a material breach of these Terms. Violations may result in immediate and permanent access revocation, and Koekkoek reserves the right to pursue legal remedies.

5.1 Prohibited Activities

You agree that you will not, under any circumstances:

  • Use the Platform or its features for any purpose unrelated to Koekkoek Int. Horsetransport B.V. business
  • Use passport scanning, document processing, or AI features for personal or third-party purposes
  • Attempt to gain unauthorized access to any part of the Platform, other users' accounts, or underlying systems
  • Conduct security testing, vulnerability scanning, or penetration testing without express written authorization
  • Extract, scrape, harvest, or download data from the Platform in bulk or by automated means
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Platform
  • Use the Platform to store, transmit, or process data that is unlawful, harmful, or infringes on third-party rights
  • Interfere with the Platform's operation, security mechanisms, or other users' access
  • Use the Platform to develop or provide competing services
  • Share, resell, or sublicense access to the Platform without written permission

6. Intellectual Property Rights

6.1 Platform Ownership

All rights, title, and interest in and to the Platform — including but not limited to all software, source code, algorithms, AI models (including WAI), user interface designs, system architecture, database schemas, APIs, documentation, and all associated technical implementations — are and shall remain the exclusive intellectual property of Wail Ettouil / altacode.eu.

The Platform is licensed to Koekkoek Int. Horsetransport B.V. for business operations under a separate licensing agreement. This license does not transfer ownership of any intellectual property.

6.2 Koekkoek Brand

The Koekkoek name, logo, brand identity, and associated trademarks are the property of Koekkoek Int. Horsetransport B.V..

6.3 User Data Ownership

Data that you submit to the Platform (including client information, horse data, and documents) remains your property. By using the Platform, you grant Koekkoek Int. Horsetransport B.V. and altacode.eu a limited, non-exclusive license to process this data solely for the purpose of delivering the services you have requested and for the operational purposes described in our Privacy Policy.

6.4 Reproduction & Distribution

No part of the Platform, including its software, design, documentation, or any generated outputs, may be reproduced, distributed, modified, publicly displayed, or used to create derivative works without the prior written consent of altacode.eu.

7. AI Processing & Disclosure

The Platform integrates WAI (Wail AI), a proprietary artificial intelligence system developed by altacode.eu. WAI is used to:

  • Assist with automated data entry from transport spreadsheets and documents
  • Process and extract information from horse passport scans
  • Improve operational speed and reduce manual data entry errors

WAI is an assistive technology. All AI-generated outputs, suggestions, and pre-filled data are reviewed and confirmed by authorized staff before any operational action is taken. No fully automated decisions are made that produce legal effects or similarly significant impacts on any user.

Usage patterns and correction data may be used in anonymized form to improve WAI's accuracy and capabilities. This anonymized data, and any AI models trained on it, are the intellectual property of altacode.eu.

8. Disclaimers & Limitation of Liability

8.1 Platform Availability

The Platform is provided on a "best-effort" basis. While we strive to maintain high availability, we do not guarantee uninterrupted, error-free, or secure access to the Platform at all times. Scheduled and unscheduled maintenance, updates, and external factors may affect availability.

8.2 Accuracy of AI Outputs

WAI is designed to assist with data processing, but AI outputs may contain errors. Staff are responsible for reviewing and verifying all AI-generated content before use in operational decisions. Neither Koekkoek Int. Horsetransport B.V. nor altacode.eu are liable for consequences arising from unverified AI outputs.

8.3 Limitation of Liability

  • The Platform is provided for logistics management purposes. Neither altacode.eu nor Koekkoek Int. Horsetransport B.V. shall be liable for transport delays, animal welfare incidents, losses, or operational decisions made using the Platform
  • In no event shall the total aggregate liability of altacode.eu or Koekkoek Int. Horsetransport B.V. exceed the amount of fees actually paid by you for use of the Platform in the twelve (12) months immediately preceding the event giving rise to the claim
  • Neither party shall be liable for indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or theory of liability

9. Indemnification

You agree to indemnify, defend, and hold harmless Koekkoek Int. Horsetransport B.V., altacode.eu, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms, your misuse of the Platform, or your violation of any applicable law or regulation.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

11. Termination

  • Koekkoek Int. Horsetransport B.V. reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, particularly in cases of suspected Terms violation or security breach
  • Upon termination, you may request an export of your personal data in a machine-readable format before deletion, subject to the data retention obligations described in our Privacy Policy
  • Provisions that by their nature should survive termination (including, without limitation, intellectual property rights, limitation of liability, and indemnification) shall survive
  • All data retention obligations under Dutch and EU law remain in effect regardless of termination

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Koekkoek Int. Horsetransport B.V. with respect to the use of the Platform, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

14. Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or by other appropriate means at least 30 days before taking effect. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the updated Terms.

Your Data Protection Rights

Under the General Data Protection Regulation (EU) 2016/679 ("GDPR"), you have comprehensive rights regarding the personal data we hold about you. This page explains each right in detail, how to exercise it, and what to expect from us.

These rights apply to all natural persons whose personal data is processed through the Koekkoek Platform, regardless of your role (client, driver, guest, or any other capacity).

Right of Access (Article 15 GDPR)

You have the right to request confirmation as to whether we are processing your personal data. If we are, you are entitled to receive:

  • A copy of all personal data we hold about you
  • The purposes of the processing
  • The categories of personal data concerned
  • The recipients or categories of recipients to whom your data has been or will be disclosed
  • The envisaged retention period, or the criteria used to determine that period
  • Information about the existence of automated decision-making, including profiling
  • Where data was not collected from you directly, any available information about the source

We will provide this information free of charge. For manifestly unfounded or excessive requests (particularly if repetitive), we may charge a reasonable fee or refuse to act on the request, providing reasons for the refusal.

Right to Rectification (Article 16 GDPR)

You have the right to obtain the correction of inaccurate personal data and the completion of incomplete personal data concerning you. Where possible, you can update your information directly through the Platform. For data you cannot modify yourself, contact us and we will make the corrections promptly.

Where we have disclosed your data to third parties (such as regulatory authorities), we will inform them of the rectification where reasonably possible.

Right to Erasure — "Right to Be Forgotten" (Article 17 GDPR)

You have the right to request that we delete your personal data without undue delay in the following circumstances:

  • The data is no longer necessary for the purposes for which it was collected or processed
  • You withdraw your consent (where consent was the legal basis for processing) and there is no other legal ground for the processing
  • You object to the processing under Article 21 and there are no overriding legitimate grounds
  • The data has been unlawfully processed
  • The data must be erased to comply with a legal obligation under EU or Member State law
Exceptions to Erasure Certain data cannot be deleted where retention is required by law. This includes financial records retained under Dutch fiscal law (7 years), animal transport documentation required under EU Regulation (EC) No 1/2005, and TRACES records required by competent veterinary authorities. In such cases, we will inform you of the specific legal basis for retention and the expected deletion date.

Right to Restriction of Processing (Article 18 GDPR)

You have the right to request restriction of processing (meaning your data is stored but not actively used) in the following situations:

  • You contest the accuracy of the data — restriction applies while we verify accuracy
  • The processing is unlawful but you prefer restriction over erasure
  • We no longer need the data but you require it for the establishment, exercise, or defense of legal claims
  • You have objected to processing under Article 21 — restriction applies while we assess whether our legitimate grounds override yours

While processing is restricted, we will only store the data and will not process it further (except with your consent, or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another person).

Right to Data Portability (Article 20 GDPR)

Where processing is based on your consent or on a contract, and the processing is carried out by automated means, you have the right to:

  • Receive your personal data in a structured, commonly used, and machine-readable format (JSON or CSV)
  • Transmit that data to another controller without hindrance from us
  • Request that we transmit the data directly to another controller, where technically feasible

This right applies to data you have provided to us. It does not extend to data we have inferred or derived from your data through analysis or processing.

Right to Object (Article 21 GDPR)

You have the right to object, on grounds relating to your particular situation, to the processing of your personal data where we rely on legitimate interests (Article 6(1)(f)) as the legal basis. Upon receiving your objection, we will cease processing unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or the processing is necessary for the establishment, exercise, or defense of legal claims.

Rights Related to Automated Processing (Article 22 GDPR)

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

The Koekkoek Platform uses WAI (Wail AI) as an assistive tool only. All AI-generated outputs are reviewed and confirmed by authorized staff. No decisions with legal or significant effect on you are made solely by automated means.

How to Exercise Your Rights

To exercise any of your data protection rights, please contact us using the details below. We aim to respond to all legitimate requests within 30 calendar days of receipt. If your request is particularly complex, or you have made a number of requests, we may extend this period by up to two additional months, and will inform you of any extension within the first 30 days.

For your protection, we may need to verify your identity before processing your request. This may involve asking for additional information to confirm you are the person whose data is being requested.

GDPR-Compliant Data Deletion Process

We maintain a formal data deletion process that complies with Articles 17 and 19 of the GDPR. Upon receipt and verification of a valid erasure request, we will:

  • Identify all personal data associated with the requesting individual across all Platform systems and backups
  • Delete all personal data not subject to mandatory legal retention requirements
  • Anonymize any data retained for AI improvement purposes, ensuring it can no longer be attributed to you
  • Revoke all active sessions, access codes, and authentication credentials associated with your account
  • Notify any third parties to whom your data has been disclosed of the erasure request, in accordance with Article 19 GDPR
  • Provide written confirmation of the actions taken within 30 calendar days

Where certain data must be retained due to legal obligations, we will clearly identify the specific data, the legal basis for retention, and the date on which it will be deleted.

Supervisory Authority

If you are not satisfied with our response to your data protection request, or if you believe that we are processing your personal data in violation of the GDPR, you have the right to lodge a complaint with a supervisory authority.
